Rural affordable housing rarely runs on one source of capital. Projects that combine HUD and USDA Rural Development financing have long answered to two agencies at once, each with its own environmental review and its own physical inspection. Sen. Ricketts, who introduced the Streamlining Rural Housing Act, described the problem plainly: dual-funded projects "have to follow separate processes for environmental review and housing inspections for both agencies," which can add cost and delay completion.

The complication is who has to fix it. The 21st Century ROAD to Housing Act became law on July 11, and HUD carries roughly 70% of the 125 federal actions it identifies, including nine new rulemakings. HousingWire reported on September 11 that HUD staffing sits near 5,800, down from 8,800 in fiscal 2024, a 34% decrease, and that a typical HUD rulemaking takes 18 months to two years to finalize. A law promising faster rural approvals is being implemented by a smaller department.

On September 29, USDA Secretary Brooke Rollins and HUD Secretary Scott Turner signed a memorandum of understanding under Section 802 of the ROAD Act, the Streamlining Rural Housing Act. The agreement is aimed at coordinating environmental review, environmental regulations, and physical inspections into one effort across the two agencies' housing programs. As introduced, the bill directed the agencies to evaluate categorical exclusions for dual-funded projects, set a process for designating a lead agency so that one department can adopt the other's environmental assessments, and evaluate a single joint inspection process. It also called for an advisory working group of nonprofits, state housing agencies, builders, property managers, public housing agencies, and residents.

The MOU is a framework, and it does not touch land costs, labor, or insurance. The value to a sponsor also depends on details that are not yet visible: which categorical exclusions are actually created, whether adoption of the other agency's review is automatic or discretionary, and whether a joint inspection replaces the two current ones or sits on top of them.

This signals that some ROAD Act implementation can run through agency agreements rather than a full rulemaking, the faster path when staffing is tight. My view is that the inspection piece matters most. Environmental review is a one-time cost at the front of a deal, but inspections follow a property through its operating life, so a single standard would help owners of existing dual-funded portfolios as much as new construction.

Sponsors, lenders, and syndicators with rural pipelines should read the MOU text now and watch for the advisory group.
