# Housing for the 21st Century Act: What It Really Changes for LIHTC Deals in 2026

David Opalek February 25, 2026 2 minute read [Housing Policy](https://dane-isaac.com/dane-isaac-insights/tag/housing-policy)[Affordable Housing](https://dane-isaac.com/dane-isaac-insights/tag/affordable-housing)

In a year when many sponsors hoped for a dramatic fix to the affordable housing shortage, 2026 is looking more like a structural reset. The combination of the Housing for the 21st Century Act and recent HUD/CDFI appropriations doesn't erase feasibility gaps, but it does quietly change how LIHTC deals get financed and underwritten.

On the capital side, one of the most meaningful shifts is the expansion of the public welfare investment cap from 15% to 20% for certain financial institutions. That sounds technical, but it matters: a higher cap gives banks and other regulated investors a bit more room to provide LIHTC equity and related community investments without tripping internal limits. In markets where investor appetite—not just allocation—is the bottleneck, that extra headroom can keep pricing from softening further as construction costs and insurance remain elevated.

At the same time, early‑February appropriations delivered relatively stable, and in some cases increased, funding for HUD and the CDFI Fund. That's a relief compared to earlier proposals for deep cuts, and it preserves critical soft sources and credit enhancement that many 4% bond and 9% deals now assume in their stacks.

For policy and nonprofit leaders, the implication is that capital-side tools are improving at the margin—but only if they're matched with program designs that acknowledge today's cost and rate environment. For developers and investors, the bar is higher: deals that relied on thin contingencies and optimistic rent growth now need sharper underwriting around construction risk, permanent debt sizing, and long‑run operating expenses.

The opportunity in 2026 is to treat these federal changes as levers, not silver bullets. States, cities, and mission-driven sponsors that align their QAPs, RFPs, and local incentives with the new federal toolkit—while still confronting zoning, infrastructure, and timeline friction—will be better positioned to move deals from "interesting concept" to financial close.
